Provide the Option for Shared Authority

Dear Smokefree Supporter:

The South Dakota House of Representatives is considering legislation that could increase the number of smokefree places in South Dakota.

House Bill 1237 – an act to allow local units of government the authority to regulate tobacco products -- provides a mechanism for local units of government to go above the minimum standards of tobacco regulation set by the state legislature and address tobacco issues, including smokefree places, in their local communities with stricter regulations.

The South Dakota Tobacco Free Kids Network strongly supports House Bill 1237 and we need your help to demonstrate the support for shared authority of tobacco between the state legislature and local governments.

Please contact the members of the House State Affairs Committee and show your support for House Bill 1237 and the opportunity it presents to allow local communities to identify and address tobacco issues at the local level to address the toll of tobacco.  Please tell the Committee members that you strongly support House Bill 1237 and ask for their favorable consideration of the bill.

Important Points to Remember:

1.) House Bill 1237 provides the option to local governments to go above the minimum tobacco regulations set by the state if the local government determines that it needs to address an issue regarding the regulation of tobacco.  House Bill 1237 is a local control option and does not force any local government to exceed the minimum regulations set by the legislature, but it does allow those communities that wish to do so the opportunity to address tobacco issues through their local government process.

2.) Community members, including business people, are more likely to engage in a community level discussion about tobacco issues.  If additional regulations are not appropriate for a community, the community will have an opportunity to discuss that, but the community should have the option of looking at additional regulations that may be needed.

3.) Rather than addressing tobacco regulation solely at the state level, shared authority allows communities to tailor tobacco regulations as needed and accepted by the local community and does not require a one-size fits all state law to address tobacco issues.
